Terms & Condition
1. INTRODUCTION
The “Terms of Service and Conditions” agreement (referred to as “Agreement”), which outlines the conditions and rules governing the commissioning of artwork by OCTOPPLE. By proceeding with a commission and making a payment, you acknowledge and agree to the terms presented in this document. Please read these terms carefully before finalizing your commission.2. COMMISSION PROCESS
Initial Draft: Upon request and payments delivered, an initial rough draft will be created. Depending on personal time constraints, this sketch may be completed within the same day or take up to 1-3 weeks.
Feedback: Once the draft is complete and approved by you, OCTOPPLE will proceed to the next stage of the process.
Final Artwork: The final completed commission may take approximately 2-8 weeks, depending on the complexity of the piece.Please understand that I am a full-time student, and I appreciate your consideration of my workload.3. PERSONAL vs COMMERCIAL COMMISSION
Personal Commission: Artwork created for personal use, such as displaying in private Discord servers or using in roleplaying sessions, must not involve any form of redistribution or profit.
Commercial Commission: Commercial commissions entail the intention of generating profit or promoting a business. This includes using the artwork on social media, for streaming or collaborative projects, or for promotional materials.4. DELIVERABLES
Final Artwork: Once the commission is complete, you will receive the final artwork via email.
File Format: Artwork will be delivered in PNG format.
Size: The default size is 2000×2000 pixels, unless a different size is specified during the commission process.
Alternate Formats: You may request other file formats for the commissioned artwork, excluding the original working file.The artwork will be watermarked, DO NOT REMOVE.5. USAGE RIGHTS and COPYRIGHT
Artwork Ownership: OCTOPPLE retains full copyright and ownership of the commissioned artwork, even for personal commissions.
Artist Portfolio: OCTOPPLE may showcase the commissioned artwork in their portfolio and for promotional purposes.
Client Usage: Clients are not permitted to reproduce, modify, or distribute the artwork without explicit permission from OCTOPPLE.6. REVISIONS
Upon draft completion, OCTOPPLE will contact you via your preferred contact.
Included Revisions: The commission fee includes 3 rounds of revisions during the creation process.
Additional Revisions: Extra revisions beyond the included rounds may be subject to additional charges.7. CANCELLATION and REFUNDS
Cancellation: Once the initial sketch is completed, payments are non-refundable.
Refund: In the event that OCTOPPLE is unable to fulfill your commission request, a full refund will be provided.8. COMMUNICATION
Preferred Communication: Communication primarily takes place via Discord or Email.
Response Time: I strive to respond to inquiries within 24 hours, unless on holidays.10. UPDATES TO TERMS
Changes to TOS: OCTOPPLE reserves the right to update these terms of service. Check the timestamp regularly in case changes have been made.

1) All payments will be made via VGen
2) Payment will be upfront, and there will be no option for REFUNDS unless I am unable to complete said commission.3) I have every right to deny commissions if I feel uncomfortable with the request or time constraints or above my personal skill set.4) Acknowledgement of commissioning me involves understanding that I have a life as a full-time student and other commitments, especially within my own personal health (I will attempt to be as efficient with every commission and maintain quality).5) Edits towards the finished commissioned piece without any communication with the artist is strictly prohibited .6) Don’t claim the art as your own! Don’t remove/alter/crop the watermark under any consequences, as I'll be putting it in a discrete area.7) Usage/uploading of commission pieces to any blockchain-related technology/network (including NFTs, Cryptocurrency, etc) is strictly prohibited.8) I have the right to either post/stream the commission piece on any social media platform or used within portfolio work (unless requested otherwise.
